Tax Objections and Disputes

Contacts: Will Marryat, James Cudmore, Ben Wilson

We excel in large and complex tax disputes. We have a reputation for managing the disputes to obtain the best outcome.

We have a deep understanding of how the Australian Taxation Office conducts audits, engages in negotiations with taxpayers, amends assessments, imposes penalties and conducts litigation, whether in the Administrative Appeals Tribunal or the Federal Court.

Our extensive experience in this area allows us to provide advice on how best to resolve a dispute.

We have successfully managed an extremely complicated dispute arising out of the application of Part IVA and cost base value-shifting provisions relating to a restructure as part of the float of a public company, which has been the subject of Federal Court proceedings for more than seven years.

We acted in the resolution of Federal Court proceedings involving the capital gains implications of disposition of a division of a public company.

We have acted for taxpayers in an extensive and well-publicised ATO investigation involving alleged off-shore arrangements.

We have managed a variety of payroll tax audits focussing on complex grouping and contractor issues.

We act in all areas, including:

  • managing audits and tax debts;
  • objecting to assessments;
  • Freedom of Information applications; and
  • negotiation, mediation and Court or Tribunal proceedings.

We also have considerable experience managing disputes arising out of State revenue laws, including:

  • stamp duty objections;
  • stamp duty audits;
  • payroll tax audits and negotiations; and
  • land tax disputes.
